Maryland Public-Access Rights

Maryland provides individuals with disabilities, parents of minor children with disabilities and qualifying trainers accompanied by animals being trained or raised as service animals with full and equal rights in public accommodations, common carriers, public transportation and other places open to the public, subject to generally applicable legal conditions.

Maryland defines a service animal as a guide dog, signal dog or other animal individually trained to perform work or tasks for the benefit of an individual with a disability. The statute also defines a service-animal trainer to include a person who trains or raises service animals, whether professionally or as a volunteer.

Housing and Extra Charges

Maryland law provides covered individuals and service-animal trainers access to housing accommodations and protects the ability to have, obtain or prepare an animal for service work. Extra compensation may not be required because of the service animal or animal in training, although responsibility may remain for actual damage caused to the premises or facilities.

Service Animals in Training

A qualifying service-animal trainer may generally be accompanied by an animal being trained in locations where a covered individual has the right to use a service animal.

Maryland law permits exclusion of an animal in training when admitting it would create a clear danger of disturbance or physical harm to an individual in the location. This specific state-law provision should not be confused with the separate federal ADA rules governing fully trained service animals.

Denial and Interference Penalties

A person may not deny or interfere with the admission of a service animal accompanying an individual with a disability or the parent of a minor child with a disability. A violation is a misdemeanor punishable by a fine of up to $500 for each offense.

Improperly denying or interfering with an animal in training that accompanies a qualifying trainer may result in a fine of up to $25 for each offense, subject to Maryland’s clear-danger exception for animals in training.
